Terms of Service

1. Acceptance of Terms

By downloading, installing, or using SchoolBuswala (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. The Service is operated by Webanav Private Limited (contact: [email protected]).

2. Eligibility & Riders

You must be at least 18 years old to create an account; date of birth is verified at signup. By registering, you confirm that all information you provide is accurate and that you have the legal capacity to enter into these Terms. Drivers must hold a valid commercial driving licence for the vehicle type operated.

Riders: you may add a child or other dependent you are the parent or legal guardian of as a “Rider” on your account so they can be enrolled for a ride. A Rider is never a separate account or login — you remain solely responsible for the accuracy of their information, for supervising their use of the Service, and you are the one giving consent, on their behalf, to the data practices described in our Privacy Policy.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorised access. We are not liable for losses resulting from unauthorised use of your account where you failed to notify us promptly.

4. Driver Obligations

Drivers who register as vehicle operators agree to:

• Hold all licences, permits, and insurance required by applicable Indian law.
• Maintain accurate vehicle and route information within the app.
• Enable GPS tracking during active trips.
• Treat passengers with respect and ensure their safety.
• Maintain a valid operator subscription (₹299/month) to access trip management features.

5. Payments and Billing

Parent transport fees: monthly transport fees are automatically invoiced to parents based on the fare set on each route. Payments are processed via Razorpay. Invoices are generated on the 1st of each month.

Driver payouts: parent transport fees are transferred to the driver's linked bank account after payment is received, subject to Razorpay's payout processing times. This is separate from the operator platform plan below.

Operator platform plan: drivers pay ₹299/month for access to route management, tracking, and billing tools. Subscriptions auto-renew monthly and may be cancelled at any time; cancellation takes effect at the end of the current billing period.

Refunds: payments are generally non-refundable. Disputes must be raised within 7 days of the charge by contacting [email protected].

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose.
• Provide false information about yourself, your vehicle, or passengers.
• Attempt to reverse-engineer, hack, or disrupt the Service.
• Abuse the payment or payout system.
• Harass, threaten, or harm other users.

7. Location Data

By using the driver app, you consent to the collection and sharing of your GPS location with passengers assigned to your active trip. Location sharing stops when the trip ends. Parents consent to their Riders' trip data (route, pickup/drop times) being visible to the assigned driver.

8. Communications

By providing a mobile number, you agree to receive OTPs and operational messages (trip status, pickup/drop confirmations, payment receipts) via SMS, push notification, and email. We will only send you messages via WhatsApp if you separately opt in to WhatsApp notifications in the app; you can withdraw this opt-in at any time in Settings.

9. Intellectual Property

All content, branding, and technology in the Service are owned by Webanav Private Limited or licensed to us. You may not copy, modify, or distribute any part of the Service without prior written consent.

10. Disclaimers

The Service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted availability, accuracy of GPS data, or the conduct of drivers or passengers. SchoolBuswala is a technology platform and is not a transport operator; we are not responsible for incidents occurring during transportation.

11. Limitation of Liability

To the maximum extent permitted by law, Webanav Private Limited shall not be liable for indirect, incidental, special, or consequential damages arising from use of the Service, including loss of data, revenue, or personal injury. Our total liability for any claim shall not exceed the amounts you paid to us in the 3 months preceding the claim.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via the app or email at least 7 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
